O R D E R
The petitioner was a Estate Officer employed in the respondent University. He was dismissed from service. He was in occupation of the quarters. By the impugned order dated 05.06.2015, he was asked to vacate the quarters forthwith. This writ petition is filed challenging the same.
2. While the learned counsel for the petitioner has submitted that the writ petition against the respondent is maintainable, since the respondent University is discharging public function, the learned counsel for the respondent University has submitted that the writ petition is not maintainable against the respondent University, a private educational institution.
3. Without going into those issues, after a lot of persuasion from this Court, the respondent University has agreed to permit the petitioner to occupy the quarters till 31.12.2015 to enable his children's studies. the petitioner shall continue to pay the usual rent and the charges for amenities. The learned counsel for the petitioner has given an undertaking that the petitioner would vacate the quarters on or before 31.12.2015. 4. In view of the aforesaid subsequent development, learned counsel for the petitioner has submitted that the allegations made in the affidavit filed in support of this writ petition could be taken as withdrawn for the present, without prejudice to the appeal pending before the Chancellor of the respondent University.
