Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus, to direct the respondents to consider the petitioner representation dated 23.05.2015 and increase and enhance the age of the petitioner's retirement from 60 to 65 years as per the directions issued by the Government of India and allow me to continue the petitioner services till she attain the age of 65 years, with all consequential benefits. By consent, the writ petition is taken up for final disposal.
2. The petitioner claims that she is an Anganwadi worker and according to her, she was initially paid a honorarium pay and it was very meager and she is carrying on very many works of the Central Government as well as the State Government. It is further stated by the petitioner that after 01.01.2006, she was given nonstandardised scales of pay and grade pay and it is very meager when compared to other employees of the Government of Tamilnadu. The
petitioner has also expressed the grievance that even after the introduction of the above scales of pay, she is getting only around Rs.8000/- that too, after rendering more than 20 years of service and brought to the knowledge of the 1st respondent in the form of representation dated 23.05.2015, stating among other things, that the Government of India, had raised the age of retirement for Anganwadi workers to 65 years, vide proceedings dated 01.03.2003 in O.M.No.1-1/2007-CD-1 [Vol.II] and directed all the State Governments to uniformly fix the age of retirement for all Anganwadi workers as 65 years and in spite of such a direction, it has not been done and prayed for a positive consideration of the said representation. Since the representation has not been favoured with any response, the petitioner has come forward with this writ petition.
3.Mr.M.Muthupandian, learned counsel for the petitioner draws the attention of this Court to the typed set of documents and submitted that this Court, in similar facts and circumstances, had disposed of the writ petitions in WP.Nos.13484 to 13489/2015, by the common order dated 30.04.2015 and hence, prayed that similar orders may be passed.
4.This Court had heard the submissions of Mrs.P.Rajalakshmi, learned Government Advocate who accepts notice on behalf of the respondents.
5.This Court, taking into consideration the limited scope of prayer and without going into the merits of the representation dated 23.05.2015, directs the 1st respondent to consider and dispose of the said representations of the petitioner in accordance with law and pass orders as expeditiously as possible and not later than eight weeks from the date of receipt of a copy of this order and inform the decision taken to the petitioner. 6.The writ petition is disposed of accordingly.
