ORDER

1. This Writ Petition is filed for issuance of a Writ of Mandamus, directing the Respondent to declare the status of the Petitioner Association as 'Active'.
2. The case of the Writ Petitioner is that the Petitioner Association was registered under the Societies Registration (Pondicherry Amendment) Act, 1969 and they were regularly submitting Form VII, Auditor Report, Balance Sheet and all other connected documents, before the Registrar of Companies. However, it is contended that despite filing of the said documents, the Petitioner Association has been notified as "Inactive". The representation, dated 16.11.2018 of the Petitioner to notify the Petitioner Association as Active, has not been considered. Hence, this Writ Petition has been filed.

This Court finds that the contention of the Writ Petitioner that the Petitioner Association had been regularly submitting Form VII, Auditor Report and Balance Sheet and all other connected documents is required to be verified and it is also to be verfied as to whether the said documents were in consonance with the Act. Further more, this Writ Petition was filed in the year 2019, alleging that the Petitioner Association was notified as "Inactive" in the month of June 2018. Due to efflux of time, it is not sure whether the Petitioner Association had filed the Form VII, Auditor Report and Balance
Sheet and all other connected documents, for the previous year, i.e. 20172018. Typed set of papers filed by the Writ Petitioner only indicates that the Writ Petitioner submitted the said documents only upto 2016-2017. In such circumstances, a writ of mandamus, as prayed for, cannot be issued. However, the Petitioner Association is at liberty to make a representation, seeking for revival of the Association, by submitting Form VII, Auditor Report, Balance Sheet and all other connected documents, for the relevant years, required under law, before the Authority Concerned.
4. With the above observations and liberty, this Writ Petition is disposed of. No costs.
