Mr.Balaji, Standing Counsel for R1 to R3 Common Order Writ Petitions are filed by the petitioners to direct the respondents to allot a flat to them under the Nochikuppam Housing Scheme based on their
representations dated 08.01.2026 and 09.01.2026 respectively.
2. Case of the petitioners is that they are the residents of the Nochikuppam area for several decades and after the 2004 Tsunami, the Government of Tamil Nadu introduced housing redevelopment project aimed at providing pucca houses to the slum dwellers and coastal inhabitants. During the initial survey, the petitioners name were duly recorded as eligible occupants and thereby during the year 2015, the respondents issued a notification directing the residents to vacate their old structures for construction of new multi-storeyed apartments and now the said construction also got completed. However despite the petitioners eligibility for assignment, their name has been omitted from the allotment lists. Hence, they made several representations to the office of the 3rd respondent, however, no fruitful result has been yielded. Therefore, the petitioners once again made representations dated 08.01.2026 and 09.01.2026 respectively to the 1st respondent and even then no action has been taken on the said representations. Aggrieved by the same, the petitioners are before this Court.
3. The learned counsel appearing for the petitioners would submit that it would suffice, if the first respondent is directed to dispose of the representation of the petitioners dated 08.01.2026 and 09.01.2026, on merits and in accordance with law, within a specified period.
4. The learned counsel appearing for the respondents has no objection for such an order being passed by this Court.
5. Heard the learned counsel appearing for the petitioners and learned counsel appearing for the respondents.
6. In view of the limited request made by the learned counsel appearing for the petitioners, this Court, without going into the merits of the case, directs the first respondent to consider the representations of the petitioners dated 08.01.2026 and 09.01.2026 respectively and pass appropriate orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
7. With the above direction, the Writ Petitions are disposed of. There shall be no order as to costs.
