This Criminal Original Petition is filed to transfer the case in S.T.C.No.449 of 2023 on the file of the Judicial Magistrate I, Bhavani to the Judicial Magistrate, Sriperumbudur.

According to the petitioner, the case under Section 138 of Negotiable Instruments Act, been filed with an intention by the respondent/complainant showing his residence as Salem and in fact he resides at Porur, Chennai. Since the complaint been filed before the Judicial Magistrate No.I, Bhavani, the petitioner is put to great hardship. Therefore, seeks transfer of the case from Bhavani to Sriperumbudur. 3.

Section 407 Cr.P.C., enable the Court to transfer the case from one Court to another. However, it must be based on sound reasoning. The contention raised by the petitioner does not satisfy the said parameters. Hence this Criminal Original Petition for transfer stands dismissed. Consequently, the connected Criminal Miscellaneous Petition is closed.
