PRAYER:

The Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to direct the third respondent police not to harass the petitioner based on the false and bogus cases which where registered for statistical purpose. For Petitioner : Mr.R.Sasikumar For Respondents : Mr.V.Meganathan, Government Advocate(crl. side)

O R D E R

This Criminal Original Petition has been filed to direct the third respondent police not to harass the petitioner based on the false and bogus cases which where registered for statistical purpose.

2. Mr.R.Sasikumar, learned counsel for the petitioner would submit that the petitioner is an accused in Crime No.15 of 2022.

The third respondent police repeatedly harassing the petitioner under the guise of enquiry.

3. Mr.V.Meganathan, learned Government Advocate (crl.side) would submit that the petitioner is a habitual offender and 29 previous cases are against him. Recently, a case in Crime No.15 of 2022 has been registered by the third respondent against the petitioner. He would submit that the third respondent is not harassing the petitioner.

4. In reply, learned counsel for the petitioner would submit that the petitioner was released on bail from all the 29 previous cases. In Crime No.15 of 2022, he got arrested and granted bail. Even thereafter, the third respondent is harassing the petitioner.

5. Under such circumstances, once the regular FIR has been registered, the question of "Not to harass" will not arise. Any direction issued by this Court at this stage will amount to interfering with the investigation conducted by the respondent police.

6. It is made clear that the third respondent shall issue proper summon for the petitioner's appearance and conduct enquiry.

7. With the above direction, this Criminal Original Petition stands disposed of.
