Mr.U.Baranidharan, SGP for R1 Notice dispensed with for R2 Order This writ petition has been filed to direct the first respondent to register the Sale Deed dated 23.07.2025, presented by the petitioner for registration. 2.Mr.U.Baranidharan, learned Special Government Pleader accepts notice on behalf of the first respondent. Since no adverse order is being passed against
the second respondent, notice to the second respondent is dispensed with by this court.
3.Admittedly, a protest petition has been submitted by the second respondent with the first respondent opposing registration of any document for the property, which is the subject matter of the Sale Deed dated 23.07.2025, presented by the petitioner for registration. 4.In view of the same, the second respondent will have to be heard by the first respondent before taking a decision as to whether the Sale Deed presented by the petitioner can be registered or not.
5.Learned counsel for the petitioner has stated no objection if the second respondent is heard by the first respondent before the first respondent takes a decision as to whether the sale deed presented by the petitioner can be registered or not.
6.Accordingly, this writ petition is disposed of by directing the first respondent to conduct an enquiry by hearing the petitioner as well as the second respondent and after giving due consideration to the respective contentions, take a final decision as to whether the Sale Deed dated 23.07.2025 presented by the petitioner can be registered or not, within a period of four weeks from the date
of receipt of a copy of this order. In case the first respondent decides to refuse registration of the sale deed dated 23.07.2025 presented by the petitioner, the first respondent shall pass a speaking order as to why the sale deed presented by the petitioner cannot be registered.
