ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 379 of IPC and 21 of Mines and Minerals Act in Crime No.106 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found transporting one unit of river sand in a tractor without any valid license. Hence, the law enforcing agency registered a case against the petitioner.

3. The learned counsel for the petitioner submitted that the petitioner did not commit any offence as alleged by the prosecution. Hence, he sought for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate submitted that the petitioner attempted to transport river sand illegally in a tractor. When the vehicle was inspected, one unit of river sand was found. He further submitted that the petitioner has involved in one previous case similar in nature and also a case under Section 302 of IPC, is pending. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5.In view of the submission made by the learned Government Advocate that the petitioner has involved in one previous case and also a case for the offence punishable under Section 302 of IPC, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 28/04/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
