A.No.4143 of 2024 in C.S.No.17 of 2021 RMT.TEEKAA RAMAN,J., Mr.N.R.Elango, learned Senior Counsel for the applicant/petitioner.

2. By an order dated 24.11.2023, the learned Master appears to have observed as under:- P.W.1 is cross examined in part. During the cross examination, the learned Senior counsel intend to mark a document which was filed along with the written statement which is downloaded article along with a 65(B) certificate. The witness does not admit it and the counsel for the plaintiff strongly objected to mark the document on the ground that it is denied by the witness and the senior counsel can put question on the basis of the contents of the document. But the senior counsel for the defendant replied that without marking the document, he cannot cross examine the witness as to the contents of the document. In these circumstances, the P.W.1 cross could not be proceeded. Hence, Post before the Court for clarification.

3. Subsequently, by an order dated 07.03.2024, the learned Judge has passed an order as under:

The learned counsel on either side are present.

2. Post before the learned Additional Master - IV on 19.03.2024 for appearance of P.W.1 for cross examination and the cross examination shall be completed before 22.03.2024. Thereafter, if any other evidence persists on the side of the plaintiff, both in-chief and cross shall be completed before 28.03.2024. Then, the defendants' side evidence shall be completed in the month of April,2024.

4. On 19.03.2024, the learned Master was on leave. On 21.03.2024, P.W.1 was not in position to come to the Court. On 21.03.2024, the learned Senior Advocate for the defendant is otherwise engaged and hence could not be completed as directed by the order dated 07.03.2024 and hence this petition.

5. In the interest of justice, this petition is allowed and the time is extended by four weeks for conducting cross examination of the plaintiff. https://www.mhc.tn.gov.in/judis
