Prayer:- Criminal Original Petition filed under Section 482 Cr.P.C. to direct the respondent/police (i.e.) the state, rep by the Inspector of Police, T-13, Kundrathur Police Station, Ambattur, Chennai, to file the final report pertaining to the petitioner's complaint dated 08.01.2011 which was registered in Cr.No.10 of 2011 under Sections 406, 420, 465, 468, 471 IPC pending on the file of the respondent police herein. ORDER
This petition has been filed to direct the respondent police to file the final report pertaining to the petitioner's complaint dated 08.01.2011 which was registered in Cr.No.10 of 2011 under Sections 406, 420, 465, 468, 471 IPC pending on the file of the respondent police herein.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.
3. It is seen that the FIR in this case was registered in the year 2011 and there was no progress in the
investigation and therefore, this Court had to monitor the investigation from time to time. Mr.D.Baskaran, Inspector of Police, T-13 Kundrathur Police Station, Ambattur has filed an additional Status Report, wherein, it is stated as follows in paragraphs 2 and 3.
"2. It is respectfully submitted that this Additional Status Report may be treated as part and parcel of the earlier Status Report and Additional Status Report filed by me on 21.08.2015 before this Hon'ble High Court.
3. It is submitted that, the above said case was posted for hearing on 15.09.2015, wherein this Hon'ble High Court passed the following order:
"Under such circumstances, the Sub-Registrar, Tambaram is directed to immediately provide the documents required by the investigating officer, if available."
4. Today when the matter was called, learned Additional Public Prosecutor submitted that the Inspector of Police has obtained specimen signatures from the accused and sent the disputed documents to the learned Judicial Magistrate, Sriperumbudur on 12.10.2015. Learned Judicial Magistrate, Sriperumbudur is directed to immediately send the documents to the Tamil Nadu Forensic Sciences Laboratory with a request to the Laboratory to complete the comparison process and send the report within three months from the date of receipt thereof. Since it will take some time for the expert to give opinion, this Court is of the view that it will serve the interest of justice if a direction is given to the respondent police to complete the investigation in Cr.No.10 of 2011 within six months from the date of receipt of a copy of this order.
