2. Hence, and having regard to the fact that the appellant has been incarcerated since the date of sentence, the delay of 65 days in filing the Criminal Appeal is condoned and this Miscellaneous Petition is ordered.

3. Registry is directed to number the Criminal Appeal, if it is otherwise in order, and list the same for admission.
