ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Section 17 of the Juvenile Justice (Care and Protection of Children) Act 2015, 6 and 24(1) of Cigarette and other Tobacco Products Act 2003 in Crime No.1259 of 2020, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was in possession of 60 kgs tobacco products for the worth of Rs.1,36,000/-. Hence, a case has been registered against the petitioner.

3. The counsel for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution. Hence he prays for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) submits that the petitioner had entered into a criminal conspiracy and divided the contra band into lesser quantity in order to escape from the hands of the respondent and the total quantity seized was 60 kgs of tobacco products which is more than the commercial quantity. Hence he vehemently opposed for grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

5. Considering the fact that the value of contraband is very high more than the commercial quantity, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
