Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus, to direct the respondents to consider the petitioner's representations dated 22.09.2014 and 13.12.2014. For Petitioner :

All though there is no representation on behalf of the petitioner, this Court is inclined to dispose of this writ petition in the absence of the petitioner, as no adverse orders are being passed. 1/4

The case of the petitioner is that, the petitioner was working as a part time Conservancy Worker from 01.01.1973 to 28.02.2012 and had retired on 28.02.2012 and was paid a part time salary of Rs.525/- per month at the time of retirement. It is submitted that the petitioner has put in about 39 years service as a Conservancy Worker. It is the further case of the petitioner that the Government had revised the scale of pay and allowances etc., of the State Government Employees and the Teachers including employees of local bodies based on the decision of the Central Government on the recommendation of the 6th Central Pay Commission and revised the pay scale and allowances etc., with effect from 01.06.2006 and therefore, the petitioner as a Conservancy Worker was also entitled to the benefit of the 6th Central pay commission which was also implemented and adopted by the State Government.

In my view, the request of the petitioner appears to be genuine and therefore, there is no impediment in directing the respondents to consider the request of the petitioner and pass appropriate orders on merits as expeditiously as possible. Considering the fact that the petitioner would be around 75 years as on date, the exercise will be carried out by the 2/4

respondents within a period of three months after hearing the petitioner, from the date of receipt of copy of this order.

4. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
