ORDER

[Made by P.N.PRAKASH, J.] This habeas corpus petition has been filed seeking a direction to the respondents to produce the petitioner's husband viz., Arutpaari, aged 54 years, before this Court and to set him at liberty.

It is the case of the petitioner that her husband Arutpaari went to Tiruvannamalai on 09.01.2022 and thereafter, he did not return. On these ground, the present habeas corpus petition has been filed.

Today, P.Karuppannan (Mobile No.94981 35440), Grade I Police Constable - 31566, R-7, K.K Nagar Police Station, Chennai - 600 078, is present.

On instructions, the learned Additional Public Prosecutor submitted that on a complaint given by the petitioner, a petition enquiry in C.S.R.No.145 of 2022 was conducted by the Inspector of Police, R-7, K.K Nagar Police Station, Chennai and during the course of enquiry, it came to light that Arutpaari is available in Tiruvannamalai. He further submitted that this was intimated to the petitioner and the petitioner has also given a complaint to the Inspector of Police, Tiruvannamalai Taluk Police Station.

In such view of the matter, it cannot be stated that Arutpaari is in the illegal custody of the respondents herein, for the issuance of a writ of habeas corpus.

In the result, this habeas corpus petition stands closed with liberty to the petitioner to approach the Inspector of Police, Tiruvannamalai Taluk Police Station, Tiruvannamalai District, in this regard.
