Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the first respondent herein to include the name of the petitioner in the C List of Head Constables fit for promotion as Sub-Inspectors of Police (Local) for the year 2019 issued by the second respondent herein in his proceedings C.No.A1/1521/2019 O.O.No.47/2019 dated 10/05/2019 taking into account the cancellation of the punishment of deferred Black Mark for 6 months in P.R.No.13/2018 dated 27/06/2019 and restore the Police Medal benefits based on his representation dated 21/06/2019. O R D E R

The Petitioner visited with the punishment of postponement of increment for one year without cumulative effect. On appeal it was modified into one of deferred black mark for 6 months. On 27.06.2019, the punishment was set aside. Therefore, according to the petitioner he is eligible to be considered for inclusion in the C list of Head Constable fit for promotion to Sub Inspector of Police Local for the year 2019. Therefore, he made a representation on 21.08.2019 to consider him for including in the panel of Sub Inspector of Police for the year 2019. The same is pending before the respondents without consideration. Aggrieved over the same, the petitioner is before this Court. https://hcservices.ecourts.gov.in/hcservices/

2. Learned Additional Government Pleader, appearing for the respondents would contend that the validity of the panel has expired and hence the petitioner name could not be considered.

3. However, considering the facts and circumstances of the case and the limited prayer sought for, a direction is given to the respondents to consider the request made by the petitioner dated 21.08.2019 on merits and in accordance with law and pass appropriate orders within a period of eight weeks from the date of receipt of the order copy.

With the above direction, the writ petition is disposed of. No costs.
