The private notice that was sent to the 4th respondent has been returned with an endorsement "Refused". Hence, there shall be a deemed service on the 4th respondent.

3.There is no representation either in person or through counsel on behalf of the respondents 1 to 3.

4.This Civil Miscellaneous petition has been filed seeking to condone the delay of 43 days in filing the Civil Miscellaneous Appeal. 5.Heard the learned counsel for the Appellant and perused the records. 6.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 43 days is condoned.
