The application is filed to eschew the proof affidavit filed by P.W.1 Mr.Arun Kumar and permit the applicant to let in evidence through a new witness.

2. Despite several opportunities granted, as on date, there is no representation for the respondent and no counter is also filed.

3. I have gone through the affidavit filed in support of the application. It is seen that one Mr.Arun Kumar, who was examined as P.W.1 and he had filed a proof affidavit on behalf of the applicant, has been transitioned out of the Regional Office and therefore, he is not in a position to appear before the Court and give evidence and in his place one Ms.Smrithi Balaji has taken charge as the Regional Finance Manager at the Regional Office, Chennai. Therefore, the applicant seeks to eschew the evidence of Mr.Arun Kumar and permit the applicant to let in evidence through a new witness. https://www.mhc.tn.gov.in/judis

4. I am satisfied with the reasons assigned in the affidavit, in support of the application. Therefore the application is ordered permitting the applicant to let in evidence through a new witness viz., Ms.Smirithi Balaji.

5. Post the matter before the learned Additional Master I for recording evidence on 23.07.2024.
