PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of mandamus, directing the 1st respondent to conduct enquiry and dispose of the petitioner representation dated 07.03.2014 on merits and in accordance with law within a specific time limit to be fixed by this Court. Heard Mr.S.Namonarayanan, learned counsel appearing for the petitioner and Mr.R.Vijayakumar, learned Additional Government Pleader appearing for the respondents.
2. Though the 4th respondent has been served and her name is also printed in the cause list none appears for the 4th respondent.
3. The petitioner has filed this writ petition to consider the representation and issue widow certificate to her. According to the petitioner she is a lawful wedded wife of late S.Ramesh. However, the 4th respondent fraudulently created a document and misrepresented before the authorities and obtained certificate as if she is the widow of S.Ramesh. Now the petitioner seeks for cancellation of the said certificate and to issue certificate recognising her as the widow of S.Ramesh. The said representation dated 07.03.2014 is still pending. Accordingly, there will be a direction to the second respondent to issue notice to the petitioner and the 4th respondent, conduct an enquiry and thereafter consider the petitioner's representation dated 07.03.2014 and pass orders on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
4. With the above direction, this Writ Petition is disposed of. No costs.
