Alleging that the order passed by this Court in W.P.No.32435 of 2003, dated 20.04.2011, has not been complied with, the present contempt application has been https://hcservices.ecourts.gov.in/hcservices/ filed.

2. Counter affidavit has been filed by the respondent stating that the pension arrears of Rs.2,53,809/- has been paid.

3. The learned counsel appearing for the petitioners submitted that though all other amounts have been paid, a sum of Rs.23,832.10 towards gratuity has not been paid.

4. In a contempt petition, this Court cannot go into the actual amounts payable to the petitioners, when it is the specific case of the respondent that the order passed by this Court has been complied with. It is the case of the respondent that gratuity amount has been paid. Such a disputed question cannot be gone into in these proceedings. Accordingly, the contempt application is closed giving liberty to the petitioners to work out the remedy. As and when such representations are made by the petitioners, the respondent is directed to consider and pass orders on the same within a period of four weeks from the date of receipt of a copy of this order.
