ORDER

The petitioner, who apprehends arrest by the respondent police for the alleged offences punishable under Sections 69 of BNS Act, in Crime No.35 of 2026 registered on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that, the petitioner fall in love with the defacto complainant and on the false promise to marry her, had sexual intercourse with her, due to which she become pregnant. Hence a case has been registered against the petitioner.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the forensic report regarding DNA is yet to be received. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. Considering the nature of the allegation and the fact that the investigation is still pending, this Court is not inclined to enlarge the petitioner on anticipatory bail.
