The petitioners, who apprehend arrest for the alleged offence under Section 194 of BNSS alter into 108 of BNS (Section 174 of Cr.P.C alter into 306 of IPC) in Crime No.71 of 2025, on the file of the respondent police seek anticipatory bail.

2. The allegation against the petitioners is that the petitioners and other accused forced and threatened the deceased namely Sathish Kumar to repay a debt amount, borrowed by him. The petitioner tried to recover the money by attaching properties from the deceased, due to which the deceased was forced to commit suicide. Hence, the case involves accusations of coercion and abetment of suicide related to debt recovery.

The learned counsel for the petitioners submitted that there is a Civil Court decree against the deceased and that the deceased has also filed an Execution Petition in the year 2023 and therefore there is nothing to do with such suicide. He further submitted that the petitioners are innocent and they have not committed any such offence as alleged by the defacto complainant and they have been falsely implicated in this case. He further submitted that they are ready to abide by any stringent conditions that may be imposed by this Court and they are ready to co-operate with the investigation. Hence, he prays to grant anticipatory bail to the petitioners.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, 2/4
submitted that, at the time of taking the body suicide note was recovered wherein there is a reference in respect of these accused and only based upon the suicide note, the First Information Report has been registered. He further submitted that the investigation is in the preliminary stage. Hence, he strongly opposed to grant anticipatory bail to the petitioners.

Considering the submission made by the learned Government Advocate (Crl.Side) and upon considering the date of registration of the First Information Report namely 08.03.2025, this Court is of the view that it is not an appropriate case and premature to consider the anticipatory bail application of the petitioners.
6. Accordingly this Criminal Original Petition stands dismissed. 13.03.2026 ssi C.KUMARAPPAN , J.
