The application has been filed seeking to condone the delay of 22 days in filing the written statement on behalf of all the 3 defendants. 2.
In the affidavit filed in support of the application, it had been stated that the applicants were of the impression that the plaintiff would amicably settle the issues through negotiation and therefore, they had not given instructions within the stipulated time to the counsel. But however, the written statement had to be filed. In that process there was a delay. 3.
Heard the learned counsel for the respondent/plaintiff. 4.
Taking into consideration the fact that the suit is for partition filed by a brother against his other two brothers and sister and that the Court should also explore the possibility of settling the issue, this application stands allowed.
