ORDER

The petitioner, who apprehend arrest for the alleged offence under Sections 420, 465, 467, 468, 471 and 120B of IPC, 1860, corresponds to Sections 318(4), 336(2), 338, 336(3), 340(2) and 61(2) of BNS, 2023 in Crime No.01 of 2026 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused created forged legal heirship certificate and other Government documents. The first accused lodged a complaint before the Nemili Police Station on 25.08.2023 stating that he had lost the original sale deed and the complaint was registered as CSR No.616 of 2023. Based on the said complaint, the Deputy Inspector of Police Station issued a 'Not Traceable Certificate'. Using the said certificate, the first accused fraudulently prepared and registered the settlement deed in favour of the petitioner (A2) before the Padappi Sub Registrar Officer. Hence the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent would strongly opposed to enlarge the petitioner on anticipatory bail as the petitioner fabricated Government documents and that more specifically the non traceable certificate of the police station, and further submit that the investigation is on and if the petitioner is enlarged on anticipatory bail there will be difficulty for the investigation and there is a possibility of tampering the witnesses.

5. In such view of the position, taking into consideration of the initial stage of the investigation, this Court is not inclined to enlarge the petitioner on anticipatory bail. Hence, this petition is dismissed. 13-03-2026 Index: Yes/No Speaking/Non-speaking order MTL
