Respondents Prayer: Petition filed under Article 226 of the Constitution of India praying for a writ of mandamus to direct respondents 1 and 3 to consider and dispose of the petitioner's representation dated 26.03.2023 within a stipulated time and to remove the encroachment made by the 4th respondent in S.No.198/2A situated in Kottamedu Village, Pappireddy Patti, Dharmapuri District.

ORDER

(Order of the Court was made by the Hon'ble Acting Chief Justice) The petitioner has filed this writ petition seeking issuance of a writ of mandamus directing respondents 1 and 3 to consider and dispose of the petitioner's representation dated 26.3.2023 and to remove the encroachment made by the fourth respondent in Survey No.198/2A situated in Kottamedu Village, Pappireddy Patti, Dharmapuri District.

2. Mr.Karthik Jagannath, learned Government Advocate, who accepts notice on behalf of respondents 1 to 3, on instructions, submitted that the land in question would be surveyed and, if any encroachment is found, the same would be removed after following the due process of law.

3. Recording the submission made by learned Government Advocate, the writ petition is disposed of by directing the respondent authorities to survey the land in question within a period of two weeks from the date of receipt of a copy of this order and, upon survey, if any encroachment is found, the same shall be removed in accordance with law, within a period of eight weeks thereafter, of course after issuing notice to all concerned, including the private respondent.
