ORDER

The Petitioner, who apprehends arrest for the alleged offence punishable under Sections 9(B)(1)(b) of the Indian Explosive Act, 1884 @ 5 of Explosives Substances Act and Section 61(2) of BNS, 2023, in Crime No.69 of 2025 on the file of the respondent police, seeks bail.

2. The case of prosecution is that a complaint was lodged stating that, while on night routine rounds, the Sub-Inspector noticed a motorcycle travelling at high speed from Latheri towards K.V.Kuppam. When the Sub-Inspector attempted to stop the said vehicle, the accused, on seeing the police, allegedly took a U-turn and sped away. The Sub-Inspector chased the vehicle and apprehended the accused. Upon inspection, it came to light that country made bomb numbering 4 was found inside the bike petrol tank cover. Hence this case.

The learned counsel for the petitioner submitted that this is the third anticipatory bail petition and the earlier petitioners were dismissed by this Court in Crl.O.P.No.s 20883 & 28026 of 2025 dated 11.09.2025 and 14.10.2025 respectively. It is further submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of bail.

4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that the petitioner has one previous case. It is also contended that the present case involves the preparation of country made boms,allegedly using crackers, to commit a serious offence. It is further submitted that earlier anticipatory bail petition was dismissed on 14.10.2025

and that there is no change in circumstances warranting reconsideration. 5.

This Court has perused the earlier order dated 14.10.2025, wherein this Court had taken note of the observations made in Crl.O.P.No.20883 of 2025 dated 11.09.2025 and found that there was no change in circumstances. Even while looking into the present submission, this Court is of the firm view that there is no change in circumstances. Further the offences alleged are serious in nature, which clearly indicates that the petitioner does not deserve anticipatory bail.
