ORDER

The petitioner apprehends arrest for the alleged offence under Sections 147, 148 and 307 of Indian Penal Code, 1860 in Crime No.145 of 2021 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner/accused failed to appear before the Court, pursuant to which a Non-Bailable Warrant (NBW) was

issued on 07.10.2025. Thereafter, an arrest warrant was executed and the petitioner was secured and remanded to judicial custody. The petitioner apprehends further action and seeks anticipatory bail.

The learned counsel appearing for the petitioner submitted that the NBW was issued on 07.10.2025 and subsequently an arrest warrant was executed against the petitioner, pursuant to which he has already been remanded to judicial custody. It is submitted that the petitioner has not wilfully absconded and he has been secured by the respondent police. The learned counsel would further submit that the petitioner is ready to cooperate with the proceedings. Hence, he prayed for granting anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner has got as many as twelve previous cases, including one under the NDPS Act and another for attempt to murder. It is further submitted that the petitioner is a habitual offender and his criminal antecedents are grave in nature. Hence, he strongly opposed the grant of anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

Considering the submission of the learned counsel on either side, it is seen that the petitioner has been involved in several previous cases, including serious offences under the NDPS Act and attempt to murder. Considering the criminal antecedents of the petitioner, the stage of the case and delay in Trial proceedings, this Court is not inclined to grant anticipatory bail to the petitioner.
