ORDER

This application has been filed, aggrieved by the order of the learned Master dated 20.08.2024, dismissing A.No.2960 of 2022 filed by the applicant seeking to condone the delay of 4553 days in re-presenting the original petition in O.P. D.No.15655 of 2009 and A.No.4955 of 2023 seeking permission to lead oral evidence in A.No.2960 of 2022 in O.P. D.No.15655 of 2009. The said petition was filed for appointment of an Arbitrator.

2.Till date, as seen from the report submitted by the registry, batta has not been filed by the applicant for taking steps to serve notice on the respondents in this application.

vga 3.The delay is an inordinate delay i.e. 4553 days. The learned Master has rightly dismissed both the applications since sufficient cause has not been shown by the applicant for condoning the inordinate delay of 4553 days in re-presenting the original petition in O.P. D.No.15655 of 2009. In this application as well, as seen from the report submitted by the registry, batta has not been paid by the applicant till date. Only to delay the inevitable, this application has been filed by the applicant. The learned Master has rightly dismissed both the applications, i.e. A.Nos.2960 of 2022 and 4955 of 2023 as sufficient cause has not been shown by the applicant for condoning the inordinate delay.

4.This Court does not find any merit in this application. Accordingly, this application is dismissed.
