[ RESPONDENTS ] PRAYER : Petition filed Under Article 226 of the Constitution of India praying to issue Writ of Mandamus, to direct the respondent to hear and dispose of the statutory first appeal preferred on 20.04.2015 against the order of the District Collector, Krishnagiri passed in proceedings R.C.No.395/1992/Mines-1 dated 12.03.2015, within a time frame,on merits and in accordance with law.

Heard Mr.V.Sanjeevi, learned Counsel appearing for the petitioner & Mr.T.N.Rajagopalan, learned Special Government Pleader accepting notice for the respondent and with their consent the Writ Petition is taken up for final disposal.

2. The petitioner seeks for a direction upon the respondent to consider and dispose of the statutory first appeal preferred by him on 20.04.2015, challenging the order passed by the District Collector, Krishnagiri, dated 12.03.2015, in and by which a penalty has been imposed on the petitioner for illicit mining. The Statutory Appeal is said to be pending and till date no order has been passed.

3. The learned Special Government Pleader submitted that reasonable time may be granted to the respondent to pass orders on the appeal preferred by the petitioner, if the same has not been already disposed of.

4. In the light of the above facts, without going into the merits of the contentions raised by the petitioner, there will be a direction to the respondent to consider the petitioner's Appeal Petition dated 20.04.2015, on merits and in accordance with law and pass orders after affording an opportunity of personal hearing to the petitioner, within a period of eight weeks from the date of receipt of a copy of this order.
