Application No.3616 of 2021 in C.S.DR.No.29366 of 2021 V.PARTHIBAN,J.

Seeking leave to sue against the 6th respondent/6th defendant and in respect of suit schedule property in the above suit, which lies outside the jurisdiction of this Court, the applicant/plaintiff has come up with this application.

2. The suit is filed for declaration and permanent injunction.

3. Learned counsel for the applicant would submit that the major part of cause of action arose in Chennai and all the defendants except the sixth defendant resides outside the jurisdiction of this Court. To avoid multiplicity of proceedings, leave is necessary to file single suit in respect of all the defendants.

4. Considering the submissions made by the learned counsel for the applicants and taking note of the averments made in the plaint, leave is granted.
