JUSTICE D.HARIPARANTHAMAN W.P.No.16863 OF 2015 R.Malathy [ PETITIONER ] Vs The Director General of Police [ RESPONDENT ] Tamil Nadu Chennai 4 Writ petition is filed under Article 226 of the Constitution of India praying for a writ of mandamus to direct the respondent herein to consider and pass orders on the petitioner's representation dt 17.4.2015 given for calculating the total length of 38 years and promote the petitioner as Inspector of Police notionally with effect from 1.9.2008 with all consequential benefits within a stipulated time as deemed fit and proper by this Court.

With the consent of the learned counsel appearing on either side, the Writ Petition is taken up for final disposal at the admission stage itself.

2.The petitioner has come forward with this Writ Petition for issuance of a writ of mandamus to direct the respondent to consider and pass orders on representation submitted by her dated 17.4.2015. 3.The petitioner initially joined the services as Woman Grade-I Police Constable on 30.6.1977, she was promoted as Head Constable during 1983 and further promoted as Woman Sub Inspector of Police on 21.02.1994. Whileso, she was removed from service with effect from 07.04.2007. Challenging the said order or removal, she filed a Writ Petition in W.P.No.21497 of 2009 and this Court allowed the said Writ Petition. Pursuant thereto, the petitioner was reinstated in service with effect from 29.12.2011, with all service benefits. Whileso, she attained the age of superannuation on 31.03.2015.

After her retirement, she submitted a representation dated 17.4.2015 before the respondent for grant of notional promotion as Inspector of Police with effect from 01.09.2008, the date on which her immediate junior was promoted. Since no action has been taken on the said representation, the petitioner has come forward with this Writ Petition, seeking to consider and pass orders on her representation, within a time frame.

4.Considering the limited scope of the prayer now sought for by the petitioner, the respondent is directed to consider the representation submitted by the petitioner dated 17.04.2015, and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
