ORDER
This Writ Petition is filed to direct the second respondent to issue police clearance certificate after considering the petitioner's application dated 19.11.2024 in file No.MA2086930745124.

Upon hearing the learned counsel appearing on behalf of the petitioner, Dr.P.G.Santhosh Kumar, learned Senior Counsel appearing on behalf of the first respondent and Dr.C.E.Pratap, learned Government Advocate (Crl.Side) appearing on behalf of the second respondent and perusing the material records of the case, the grievance of the petitioner seems to be that the petitioner now wants to leave for Canada, as on date the 2/5
petitioner holds a valid passport. For the said purpose, the said jurisdiction insists on a police clearance certificate. The petitioner has duly applied for the same, the same is not granted eventhough there is no impediment, there are no criminal cases against the petitioner. It has been stated on behalf of the first respondent that the first respondent independently has issued a notice dated 08.10.2024 calling the petitioner for enquiry on the ground that the petitioner has obtained the passport without furnishing the information that the petitioner's mother is Sri Lankan national.
3. It is stated that the petitioner is born in India and the petitioner's father is an Indian national. Be that as it may, the enquiry as contemplated by the first respondent may go on and the petitioner has already submitted the reply and the same can proceed further. The prayer in the present Writ Petition is only with reference to the Police Clearance certificate. The second respondent shall consider the application of the petitioner in terms of the relevant norms and if there is no other impediment shall issue the police clearance certificate. The said exercise shall be carried out by the second respondent within a period of four weeks from the date of production 3/5
of web copy of the order, without waiting for the certified copy of the order.
4. With the above direction, this Writ Petition is disposed of. No costs.
