ORDER : The Court Made the following order :- The petitioners, who were arrested and remanded to judicial custody on 23.03.2021 for the alleged offences punishable under Sections 341, 294(b), 323, 392, 397 and 506(ii) of IPC in Crime No.300 of 2021, on the file of the respondent police, seek bail. 2.The case of the prosecution is that the petitioners along with other accused waylaid the defacto complainant and demanded money, that on his refusal, at knife point, the accused robbed Rs.500/- from him and also assaulted him. Hence the complaint. 3.The learned counsel appearing for the petitioners submits that the petitioners are in no way connected with the alleged offence. Since they are having previous cases, they have been falsely implicated in this case. Hence, he prays for granting of bail to the petitioners 4.

The learned Additional Public Prosecutor submits that the petitioners along with other accused waylaid the defacto complainant and demanded money, that on his refusal, at knife point, the accused robbed Rs.500/- from him and also assaulted him. Further she https://hcservices.ecourts.gov.

submitted that the petitioners are habitual offenders and each of the petitioners are having five previous cases and the petitioners' earlier petition was dismissed by the lower Court. Hence she vehemently opposed for granting bail to the petitioners. 5.Considering the fact that the offence committed by the petitioners are grave in nature and the further fact that the petitioners are habitual offenders and more than five cases are pending against each of the petitioners and the petitioners being history-sheeted persons, this Court is not inclined to grant bail to the petitioners.
