ORDER
This Writ Petition has been filed challenging the impugned refusal check slip dated 04.03.2026 issued by the 3rd respondent refusing to register the settlement deed presented by the petitioner for registration on the ground that the petitioner has produced an unregistered will and has not produced the legal heirship certificate of Kuppammal.
2. Ms.K.Aswini Devi, learned Additional Government Pleader, accepts notice on behalf of the respondents.
3. The petitioner has challenged the impugned refusal check slip on the ground that the same has been passed by total non-application of mind to the supporting documents produced by the petitioner. He has produced patta standing in the name of the sellers and has also produced the legal heirship certificate of the Kuppummal's husband (G.Babu). He Page No.2 of 6
also contends that there is no requirement for registration of a will under law.
4. It is settled law that a will need not be registered. The petitioner had also produced the patta for the subject property standing in the name of the sellers. The same is also disputed by the respondents. The legal heirship certificate of Kuppammal's husband (G.Babu) has also been produced by the petitioner. Despite producing all the required documents for registration, the 3rd respondent has refused to register the settlement deed presented by the petitioner for registration by giving reasons, which are contrary to settled law. In view of the same, necessarily, the impugned refusal check slip, dated 04.03.2026 issued by the 3rd respondent has to be quashed by this Court and this writ petition has to be allowed.

Accordingly, the impugned refusal check slip, dated 04.03.2026 issued by the 3rd respondent is hereby quashed and this Writ Petition is allowed by directing the 3rd respondent to register the settlement deed presented by the petitioner for registration, if the same is otherwise is order, within a period of four (4) weeks from the date of receipt of a copy Page No.3 of 6
of this order, subject to the payment of requisite stamp duty and registration fees. No costs.
