The above Civil Revision Petition is filed challenging the order dismissing the Application in I.A.No.435 of 2018 in O.S.No.246 of 2016 taken by the revision petitioner to amend the Plaint with reference to the short and long cause title and the Court below has rejected the Application on the ground that this revision petitioner has taken out http://www.judis.nic.in

P.T. ASHA, J., mrn this application at the part heard stage and after the petitioner has subjected himself to cross examination and the amendment sought for was a post trial amendment. The plaintiff challenging the said order by way of Civil Revision Petition before this Court has pointed out that the petitioner/plaintiff has not included the name of his brothers and sisters in the said Suit and therefore the revision petitioner sought to withdraw the Application with liberty to file a fresh Application. The same is allowed and Liberty is granted subject to the maintainability of the said Application. Consequently, connected Miscellaneous Petition is closed.
