[ RESPONDENTS ] Writ petition is filed under Article 226 of the Constitution of India praying for a writ of mandamus to direct the first respondent to dispose of the Appeal dated 11.5.2015 of the petitioner against the order passed by the 2nd respondent in Pro. Na. Ka. No.A2/ 1127/ Si.Vi./ 2013 dt 6.4.2015 within a time frame on merits and in accordance with law.

O R D E R

With the consent of the learned counsel appearing on either side, the Writ Petition is taken up for final disposal at the admission stage itself.

2.The petitioner has come forward with this Writ Petition for issuance of a writ of mandamus to direct the first respondent to dispose of the Appeal preferred by the petitioner dated 11.5.2015 against the order passed by the second respondent dated 6.4.2015 within a time frame.

3.According to the petitioner the petitioner was imposed with the punishment of dismissal from service by an order dated 06.04.2015, based on the enquiry, in which no departmental witnesses were examined and no document was marked. Aggrieved over the same, the petitioner preferred an appeal before the first respondent. Since no order has been passed on the said appeal, the petitioner has come forward with this Writ Petition, seeking to consider and pass orders on the Appeal preferred by him.

4.Considering the limited scope of the prayer now sought for by the petitioner, the first respondent is directed to consider the Appeal submitted by the petitioner dated 18.05.2015, and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
