O R D E R

This Criminal Original Petition has been filed seeking to direct the respondent Police to file a final report in Crime No.1/AC/2020 of 2020.

2. The brief facts of the case are that the first accused, who was working as an Inspector of Police, Uthangarai Police Station, Krishnagiri District from 13.13.2019 to 22.05.2019, is a public servant as defined under Section 2(c) of the Prevention of Corruption Act, 1988 and the second accused is the wife of A1. The allegation against the accused is for possessing assets disproportionate to their known sources of income. The petitioner herein/A1, by abusing his position had committed the offence of criminal misconduct by intentionally enriching themselves illicitly and the second accused had abetted A1 for the same. Thereby, the respondent Police has registered a case in Crime No.1/AC/2020 of 2020 for the offence under Sections 13(2) r/w 13(1)(b) of Prevention of Corruption Act, 1988 against A1 and under Section 12 of Prevention of Corruption Act, 1988 against A2. 2/4

Learned counsel for the petitioner submitted that the First Information Report was filed during the year 2020 and the respondent is not taking effective steps to file a final report, therefore, the present petition has been filed seeking a suitable direction to the respondent to file a final report.

Learned Government Advocate (Crl.Side) submitted that since the present case relates to the possession of assets disproportionate to the known sources of income of the accused, the respondent have to collect documents from various Registrar Office as well as from the Banks, thereby, there is some delay. He further submitted that if six months time granted to the respondent, they would be able to complete the investigation and file the final report, thereby, he prayed for suitable direction.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record.

In view of the submission made by the learned Government Advocate (Crl.Side), this Criminal Original Petition stands ordered with a direction to the respondent to complete the investigation and file the final report, as expeditiously as possible, preferably, within a period of six months from the date of receipt of a copy of this order.
