ORDER
The petitioner has filed the present writ petition seeking a direction to the respondents to consider his representation dated 18.12.2025 objecting to the proposal for establishment of a vending zone in front of his property situated in S.F.No.324/1 to 4, Seiyur Road, Avinashi Taluk and consequently to ensure free ingress and egress to his property.
2. It is stated that the petitioner is the owner of property measuring about 31 cents situated on Seyur Road, Avinashi Taluk. It is the case of the petitioner that pursuant to the proceedings dated 25.10.2025, a proposal has been made for allocation of a vending zone adjacent to and in front of the petitioner's property. It is the specific grievance of the petitioner that the proposed vending zone would obstruct access to his property and prevent free ingress and egress. In such circumstances, the petitioner submitted a representation dated 2/6
18.12.2025 requesting the respondents not to locate the vending zone in a manner affecting access to his property. Since the said representation has not been considered, the present writ petition has been filed.
3. Learned counsel for the petitioner submitted that this Court may issue directions to the respondents to consider the petitioner's representation dated 18.12.2025 and pass appropriate orders, within a time frame.

Per contra, learned Government Counsel appearing for the respondents submitted that the land in question belongs to the Khadi Board and the proposal for establishment of a vending zone is within the property belonging to the said authority. The petitioner has no manner of right over the property proposed for the vending zone. In view of the above, he prayed for dismissal of this writ petition.
5. This Court has carefully considered the submissions made by learned counsel on either side and perused the materials available on record.
6. The grievance of the petitioner is that the proposed vending zone would affect the ingress and egress to his property. The respondents, on the 3/6
other hand, contend that the proposed vending zone is sought to be established within property belonging to the Khadi Board and that the petitioner has no enforceable right over the said land. It is clear that the issue on hand relates to the petitioner's alleged right of access and the effect of the proposed construction on such right. These are disputed questions of fact involving adjudication of civil rights, which cannot be effectively decided in exercise of the writ jurisdiction under Article 226 of the Constitution of India. Thus the prayer sought for by the petitioner cannot be granted in the writ proceedings. It is always open to the petitioner to work out his rights before the competent forum in the manner known to law.
7. In view of the aforesaid reasons, this writ petition stands dismissed. Liberty is granted to the petitioner to work out his remedy before the appropriate forum in accordance with law. No costs. Consequently, connected miscellaneous petition is closed.
