ORDER
The petitioner, who was arrested and remanded to judicial custody on 09.01.2026 for the alleged offence under Section 123 r/w. 110 of BNS, 2023 in Crime No.17 of 2026 on the file of the respondent police, seeks bail.
2. It is the case of the prosecution that the petitioner was found to be in possession of 260 number of Tapentadol tablets. Hence, the complaint.
3. The learned counsel for the petitioner submits that the petitioner is an innocent person and that he has been falsely implicated in this case. He further submits that the petitioner had filed two bail applications before this Court, however, the same were dismissed and the petitioner has been under incarceration since 09.01.2026. Hence, he prayed to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner was found to be in illegal possession of 260 numbers of Tapentadol tablets. He further submits that the major portion of the investigation has been completed. Hence, he prayed to dismiss the present criminal original petition.

I have given my anxious consideration to the submissions made by the learned counsel on either side and also perused the records available. 6.From the submissions made by the learned counsel for the petitioner, the petitioner has been under incarceration since 09.01.2026. Though gravity of the offence is serious in nature, considering the long period of incarceration undergone by the petitioner and also that major portion of the investigation has been completed, this Court is of the view that custodial interrogation of the petitioner is not required and is inclined to enlarge the petitioner on bail, subject to certain stringent conditions.

Accordingly, the petitioner is ordered to be released on bail on her executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.2, Tiruppur and subject to the following conditions: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall report before the respondent police daily at 10:30 a.m. and 5.30 pm. for a period of four weeks and thereafter, as and when required for interrogation;
[c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] on breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions had been imposed and the petitioner released on bail by the learned Magistrate/Trial Court itself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[g] It is made clear that no petition for relaxation will be entertained for a period of 60 days.
