The petitioner, who was arrested and remanded to judicial custody on 07.02.2026 for the alleged offences under Sections 126(2), 296(b), 309(4), 125,

311 and 351(3) of B.N.S. in Cr. No.63 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 07.02.2026 at 8 hours near Pattur Junction Road, the petitioner along with other accused waylaid and abused the defacto complainant in filthy language, threatened at knife point and snatched Rs.1,000/- from him. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent, he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He would further submit that the petitioner is under incarceration since 07.02.2026 and the petitioner is ready and willing to abide by any condition that may be imposed by this Court and hence prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police opposed to enlarge the petitioner on bail by stating that the petitioner has 4 previous cases and investigation is still pending and the petitioner is under incarceration only from 07.02.2026.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

From the submissions made by the learned Government Advocate, it is clear that the petitioner has 4 previous cases in his credit and according to the prosecution, in this case, investigation is still pending. In such view of the position, it is inexorable to dismiss the petition as the petitioner does not deserve for bail at this state, in view of his past bad antecedents.

7. Accordingly, this Criminal Original Petition is dismissed. 13-03-2026 MJS Note:
