O R D E R

The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147,148,302 of IPC and 3 of Public Property (Prevent of Damage &Loss) Act 1992 in Crime No.686 of 2019 seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other other accused persons planned and murdered one Sathish kumar. Hence the complaint.

3. The learned Additional Public Prosecutor submitted that there are totally 11 accused persons in which the petitioner is arrayed as A2. There was a previous enmity between two groups. The specific allegation against the petitioner is that the petitioner called other accused persons to murder the deceased. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

4. Considering that facts and circumstances, this Court is not inclined to grant anticipatory bail in the case related to Section 302 of IPC. When this Court is about to dismiss this petition, the learned Counsel for the petitioner seeks permission of this Court to withdraw the petition.
