ORDER
(Order of the Court was made by M.S.RAMESH, J.) The present Writ Petition has been filed for the issuance of a Writ of Certiorari, to call for the entire records relating to the Impugned Order dated 09.09.2024 made in OA/310/00547/2022 passed by the Central Administrative Tribunal, Chennai Bench, and to quash the same.
2. For the same set of delinquency, framing of two charge is impermissible in service jurisprudence. This apart, the Hon'ble Supreme Court as well as this Court in several decisions, have repeatedly reiterated the legal position that inordinate delay in framing of charges for delinquency that had happened about 25 years back is also impermissible. On this ground, the Tribunal had quashed the charge memo.
3. We do not find any valid reason to interfere with the well considered order passed by the Central Administrative Tribunal, Chennai Bench. Accordingly, the Writ Petition stands dismissed. Consequently, connected Miscellaneous Petitions are closed. (M.S.R, J.) (N.S, J.) 18.03.2025 ASI
