ORDER : The Court Made the following order :- The petitioner herein, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 379 of IPC and 21(1) of Mines & Minerals (Development & Regulation) Act, 1957, in Crime No.83 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. The petitioner herein apprehends arrest for alleged mining of 1 1⁄2 units of river sand and attempt to transport it in the tipper lorry. Both the tipper lorry used for attempt to transport and the JCB used to excavate the soil were seized under mahazar. https://hcservices.ecourts.gov.in/hcservices/

3. Considering the machinery used for excavation and the quantity of the sand excavated and also the fact that the petitioner is having one previous case of similar nature, this Criminal Original Petition is dismissed.
