ORDER
(Order of the Court was made by M.S.RAMESH, J.) This Writ Petition has been filed challenging the impugned order dated 06.03.2025, rejecting the representation of the petitioner, who is the mother of the life convict, on the ground that the life convict has not completed one year from the date of his earlier leave and hence, he is not eligible for grant of leave.

The learned counsel for the petitioner submitted that the petitioner requires the presence of her son/life convict to make arrangements for her day to day needs and medical treatment and hence, she has sought for an ordinary leave for her son/life convict. The learned counsel further submitted that the life convict has undergone more than 9
years of imprisonment and will complete a period of one year on 09.07.2025 from his last leave availed.
3. The learned Additional Public Prosecutor has produced the proforma of the life convict dated 03.06.2025, as well as the report of the Probation Officer dated 19.03.2025. The Probation Officer in his report has stated that the reasons assigned by the petitioner for seeking leave for her son/life convict are true and therefore, he has recommended to grant leave to the life convict.

Considering the favourable report of the Probation Officer recommending to grant leave to the life convict, as well as the fact that the life convict will be completing one year from the date on which his earlier ordinary leave was granted for the period between 10.06.2024 to 09.07.2024, we are inclined to grant 28 days of ordinary leave to the petitioner's son/life convict.
5. Accordingly, the impugned order dated 06.03.2025 passed in No.797938/Tha.Ku-2/2025 by the second respondent, is hereby quashed.
Consequently, the petitioner's son/life convict namely T.Suresh, aged 30 years, S/o.Thirunavukarasu, Convict No.6380 and PID No.37600, now confined at Central Prison, Puzhal - 1, is granted 28 days Ordinary Leave 'without escort' commencing from 11.07.2025 to 07.08.2025, with a condition that the life convict shall report before the jurisdictional Police i.e. H1 Washermanpet Police Station, Chennai, daily at 10.30 A.M. After expiry of the Ordinary Leave, the life convict shall surrender before the Jail Authority on 07.08.2025 before 05.30 P.M. The prisoner shall utilize the leave only for the purpose for which it has been granted and shall not indulge in any other activities.
6. Accordingly, this Writ Petition stands allowed. No costs. Connected miscellaneous petition is closed.
