ORDER
This Criminal Miscellaneous petition has been filed to suspend the sentence imposed by the Special Court for Exclusive Trial of cases under SC/ST (POA) Act, 1989, Villupuram in Spl.SC No.16 of 2019, pending disposal of the Criminal Appeal.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondent.
3. Taking into consideration the facts and circumstances of the case and also of the fact that the Court below had suspended the sentence to enable the petitioners to file an Appeal and get the sentence suspended and also of the fact that the petitioners have 2/4
made out a prima facie case, this Court is inclined to suspend the sentence imposed by the Court below in Spl.SC No.16 of 2019, subject to the following conditions:
a) The petitioners shall execute a bond for a sum of Rs.5,000/- (Rupees five Thousand Only) with two sureties each for a like sum before the Special Court for Exclusive Trial of Cases under SC & ST (POA) Act, Villupuram.
b) The petitioner shall report before the Special Court for Exclusive Trial of Cases under SC & ST (POA) Act, Villupuram, on the 1st working day of every month at 10.30 a.m., pending disposal of the Criminal Appeal.
c) The petitioner shall not move out of Tamil Nadu without getting the leave of this Court, pending disposal of the Criminal Appeal.
