This Writ Petition has been filed seeking for issuance of a Writ of Mandamus to direct the third respondent herein to dispose of the petitioner's representation dated 06.09.2021 and also the reminder dated 02.02.2022 within the stipulated period as may be prescribed by this Court.
2. The case of the petitioner is that the petitioner had purchased the property in Survey No.182/2, as Plot No.837, admeasuring 2400 sq.ft, situated at Arul Murugan Nagar-Layout, Vichur Village Panchayat, Cholavaram Union, Ponneri Taluk, Thiruvottriyur, on the file of the Sub-Registrar Office, Registration District at North Madras, under the registered sale deed dated 16.07.1987, vide Document No.4017/1987. However, the Patta stands in the name of the previous vendor in respect of the aforesaid property. While so, the petitioner made a representation dated 06.09.2021 before the third respondent, seeking to issue separate Patta by effecting the name transfer from the previous vendor. As the said representation made by the petitioner has evoked no response from the third respondent, the petitioner made reminder dated 02.02.2022, seeking to consider her representation. However, till date, no order has been passed on the said representation. Hence, the petitioner has filed the present Writ Petition.
3. Though very many grounds have been raised in this Writ Petition, learned counsel for the petitioner submitted that, it would suffice if this Court issues direction to the third respondent to consider the petitioner's representation dated 06.09.2021, followed by the reminder dated 02.02.2022 and pass orders on the same within a particular time frame that may be fixed by this Court.
4. The learned Additional Government Pleader appearing for the respondents has no objection for said order being passed.
5. In view of the aforesaid submissions, this Court, without expressing any opinion on the merits of the case, directs the third respondent to consider the petitioner's representations dated 06.09.2021, followed by the reminder dated 02.02.2022 and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
6. With the above directions, this Writ Petition is disposed of. No costs.
