O R D E R

This Original Petition has been filed to appoint a Sole Arbitrator to decide the disputes that have arisen between the petitioner and the Respondent under the terms of the Agreement dated 23.05.2008.

2. Both sides have no objection to refer the matter to a Sole Arbitrator to decide the dispute that have arisen between them.

3. Accordingly, without going to the merits of the case, as agreed by both sides, this Court is appointed Mr.M. Jayachandran, Judge [Retd.], High Court, Madras, as sole Arbitrator. The learned counsel for both sides have also no objection for appointment of Judge [Retd.], High Court, Madras, as a Sole Arbitrator.

4. Having regard to the fact there is an arbitration clause in the agreement and that both parties have no objection for appointment of a sole Arbitrator, it is ordered as follows:

i) that Mr.M. Jayachandran, Judge [Retd.], High nd Main Court, Madras, residing at Door No.422, South 2 Road, Kapaleeswarar Nagar, Neelankarai, Chennai 600115, Mobile No.9444390951 is appointed as a Sole Arbitrator to enter upon reference and adjudicate the matter. ii] That the learned Arbitrator appointed herein, shall after issuing notice to the parties and upon hearing them, pass an award as expeditiously as possible, preferably within a period of six months from the date of receipt of the Order. iii] That the learned Sole Arbitrator appointed herein shall be paid fees as per the schedule and the same shall be borne by the parties equally.
