ORDER

The above writ petition has been filed for a direction to the respondent to settle petitioner surrender leave salary for 60 days for the year from 1988 to 2022 together with interest at the rate of 12 % per annum payable from the date for retirement to till the date of actual payment.

2.The petitioner was appointed as Technical Assistant in the respondent Transport Corporation on 01.02.1983. He retired from service on 31.07.2022. The grievance of the petitioner is that the retirements benefits namely Provident Fund, Gratuity, Earned Lease Salary amount and Commutation amounts were paid to the petitioner belatedly and the earned leave surrender for 60 days during 1988-2022 has not been disbursed by the respondent. Therefore, the petitioner sent a representation dated 10.12.2025 to the respondent seeking to take steps to settle the petitioner's terminal benefits. However, the same is yet to be considered by the respondent. Therefore, the petitioner is before this Court seeking the prayer as stated above.

3.Heard the learned counsel on either side and perused the materials available on record.

Considering the relief now sought for by the petitioner, this Court, without going into the merits of the case, directs the respondent to consider the petitioner's representation dated 10.12.2025 and to pass appropriate orders, on merits and in accordance with law, on the basis of the calculation submitted by the petitioner along with his representation and also considering his eligibility, within a period of four (4) weeks from the date of receipt of a copy of this order.
