PRAKASH CRIMINAL MISCELLANEOUS PETITION No.6874 of 2019 IN CRL RC.497/2019 Y.R.PAVENDAN [ PETITIONER/RESPONDENT ] Vs K.MEENAKSHI [ RESPONDENT/APPELLANT/PETITIONER ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) To stay all further proceedings in M.C.No.1 of 2011 on the file of the Judicial Magistrate-III Vellore which was confirmed in C.A.No.53 of 2015 on the file of Principal District and Sessions Judge, Vellore pending this CRL.R.C.No.497 of 2019. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.S.SARAVANAN, Advocate for the petitioner, and of M/S.KRITIKA KAMAL P. Govt. Advocate ( Crl. Side) on behalf of the Respondent, the court made the following order:- Notice of motion returnable by 08.07.2019. Private notice is also permitted.
2. Permission is granted to the petitioner to inform the learned counsel who appeared for the respondent in the Trial Court about the pendency of this petition so that the respondent enters appearance.
3. There shall be an order of interim stay on condition that the petitioner shall deposit a sum of Rs.3,00,000/- (Rupees three lakhs only) to the credit of M.C.No.1 of 2011 on the file of the Judicial Magistrate-III Court, Vellore, within four weeks from the date of receipt of a copy of this order. On such deposit, the respondent is entitled to withdraw the same. The petitioner shall pay a sum of Rs.10,000/- (Rupees ten thousand only) as ad interim maintenance every month. For the month of June 2019, the ad interim maintenance shall be paid before 30.06.2019. From the month of July 2019 onwards, https://hcservices.ecourts.gov.in/hcservices/
the ad interim maintenance shall be paid before 10th of every English calendar month by depositing in the Trial Court and on such deposit, the respondent is entitled to withdraw the same. Post the matter on 08.07.2019, under the caption "for reporting compliance".
