These two applications have been filed by the 6th defendant and Defendants 4, 5 and 7 respectively seeking condonation of delay of 450 days and 464 days in re-presenting their respective written statements.
2. The reason assigned in the affidavits filed in support of these applications is that due to the pandemic, they were unable to take back the written statements and re-file them in time.
3. No doubt, the reason given is justifiable, but, I find that the defendants/ applicants have not shown sincerity in re-filing the returned applications for condonation of delay. Atleast from July 2020 the applicants have been taking time for re-presenting the applications seeking condonation of delay. However, I do not think that the defendants should be penalised by rejecting the written statement in toto. I therefore conclude that these applications could be allowed by imposing costs. 4. Hence, these applications are allowed subject to the condition that the applicants pay a sum of Rs.5,000/- (Rupees Five Thousand only) in each of the applications to the counsel for the 1st respondent on or before 23.07.2021.
