Mr. C.R. Malarvannan. Counsel For Government Of Tamil Nadu (criminal Side) Order (Order of the Court was made by Dr.Anita Sumanth J.) The present Miscellaneous Petition seeks relaxation of the conditions imposed by this Court on 25.11.2025. The conditions imposed are as follows: (i) The petitioners shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum to the satisfaction of the learned Sessions Judge, Fast Tract Mahila Court, Tiruvannamalai; (ii) The petitioners and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the trial Court may obtain a copy of their Aadhar card or Bank pass Book and mobile numbers to ensure their identity; (iii) The petitioner shall appear before the trial Court on every Monday at 10.30 a.m.

until the disposal of the Criminal Appeal and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 of Cr.P.C. and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court.

(iv) On the failure of any of the above conditions by the petitioner/accused, it is open to the trial Court to commit the petitioner/accused into custody for undergoing the sentence.

2. Mr. Mr. C.R. Malarvannan, learned counsel for Government of Tamil Nadu (criminal Side), who appears for the respondents, on instructions, would confirm that the petitioner is diligent in abiding by the conditions that have been imposed, specifically point (iii), and would accede to the modification of the

condition to the effect that the petitioner will appear before the trial Court on the first Monday of every month at 10.30 a.m. until the disposal of the Criminal Appeal.

3. Hence, condition in S.No.(iii) imposed on 25.11.2025 is modified to read as follows:

(iii) The petitioner shall appear before the trial Court on the first Monday of every month at 10.30 a.m. until the disposal of the Criminal Appeal and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 of Cr.P.C. and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court.

4. Barring the aforesaid modification, order dated 25.11.2025 passed in Crl.M.P.No.11522 of 2025 in Crl.A.No.760 of 2024 stands unaltered.
